Terms of Service

Please read these terms carefully before using OO7 AI.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and OO7 AI, Inc. ("OO7 AI," "we," "our," or "us"), governing your access to and use of the OO7 AI platform, website, APIs, and all related services (collectively, the "Services").

By creating an account, accessing, or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you must not access or use the Services.

2. Description of Service

OO7 AI provides an AI-powered voice calling platform that enables businesses to:

  • Create and deploy AI voice agents for outbound and inbound phone calls
  • Automate customer outreach, follow-ups, appointment scheduling, and lead qualification
  • Record, transcribe, and analyze phone conversations
  • Integrate with CRM systems and other business tools via APIs and webhooks
  • Manage campaigns, contact lists, and calling workflows
  • Monitor call performance with real-time analytics and reporting dashboards
  • Maintain compliance with telemarketing regulations through built-in compliance tools

The specific features available to you depend on your subscription plan. We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

3. Account Registration

To use the Services, you must create an account. When registering, you agree to:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate
  • Maintain the security and confidentiality of your account credentials
  • Notify us immediately of any unauthorized access to or use of your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that contain false or misleading information, or that are used in violation of these Terms.

4. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You shall not:

  • Use the Services for any illegal, fraudulent, or unauthorized purpose
  • Make calls that constitute harassment, threats, or abuse
  • Send unsolicited calls or messages in violation of anti-spam or telemarketing laws
  • Violate the Telephone Consumer Protection Act (TCPA), Do Not Call (DNC) regulations, or any applicable telemarketing laws
  • Use the Services to impersonate any person or entity, or falsely represent your affiliation
  • Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Services
  • Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems
  • Transmit any malware, viruses, or other harmful code through the Services
  • Resell, sublicense, or redistribute the Services without our written consent
  • Use the Services to collect personal data without proper consent

Violation of this Acceptable Use policy may result in immediate suspension or termination of your account without notice or refund.

5. AI Voice Agent Usage

Compliance is your responsibility. While OO7 AI provides compliance tools and features, you are ultimately responsible for ensuring that your use of AI voice agents complies with all applicable federal, state, and local telemarketing laws and regulations.

When using AI voice agents through our platform, you agree to:

  • Comply with all applicable telemarketing laws, including TCPA, TSR, and state-level regulations
  • Obtain proper prior express consent (or prior express written consent, as applicable) before placing AI-generated calls
  • Not disable or circumvent the mandatory AI disclosure at the beginning of calls
  • Maintain accurate and up-to-date Do Not Call lists and honor all opt-out requests
  • Adhere to calling time restrictions (no calls before 8:00 AM or after 9:00 PM in the recipient's local time zone)
  • Ensure that all call content complies with applicable truth-in-advertising and consumer protection laws
  • Maintain records of consent and calling activity as required by law

OO7 AI provides built-in compliance features including automatic AI disclosure, time-of-day restrictions, DNC list management, and consent tracking. These tools are provided to assist you, but they do not constitute legal advice and do not relieve you of your legal obligations.

6. Subscription & Billing

6.1 Billing Cycles

OO7 AI offers monthly and annual subscription plans. Your subscription begins on the date you subscribe and automatically renews at the end of each billing cycle unless cancelled prior to the renewal date.

6.2 Auto-Renewal

All subscriptions are set to auto-renew by default. You will be charged the applicable subscription fee at the beginning of each renewal period using the payment method on file. We will send a reminder email at least 7 days before your renewal date.

6.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation takes effect at the end of the current billing period. You will retain access to the Services until the end of the paid period.

6.4 Refund Policy

Monthly subscriptions are non-refundable. For annual subscriptions, we offer a pro-rated refund for the unused portion of the subscription term if you cancel within the first 30 days. After 30 days, annual subscriptions are non-refundable but you will retain access for the remainder of the term.

6.5 Price Changes

We may change our pricing at any time. Price changes for existing subscriptions will take effect at the next renewal period, and we will notify you at least 30 days in advance of any price increase.

7. Intellectual Property

7.1 OO7 AI Intellectual Property

The Services, including all software, algorithms, AI models, user interfaces, designs, trademarks, logos, and documentation, are and shall remain the exclusive property of OO7 AI, Inc. and its licensors. These Terms do not grant you any right, title, or interest in the Services except for the limited right to use them in accordance with these Terms.

7.2 Your Content

You retain ownership of all data, content, call recordings, transcripts, contact lists, and other materials you upload, create, or generate through the Services ("Your Content"). By using the Services, you grant OO7 AI a limited, non-exclusive license to process, store, and transmit Your Content solely as necessary to provide the Services.

You represent and warrant that you have all necessary rights and permissions to upload and use Your Content through the Services.

8. Data & Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Services, you consent to the data practices described in the Privacy Policy.

If you are subject to the General Data Protection Regulation (GDPR) or similar data protection laws, please review our GDPR Compliance page for additional information about your rights.

9. Service Level

OO7 AI targets 99.9% uptime for the Services, measured on a monthly basis, excluding scheduled maintenance windows. Scheduled maintenance will be communicated at least 48 hours in advance whenever possible and is typically performed during off-peak hours.

OO7 AI is not responsible for outages, degraded performance, or service interruptions caused by:

  • Third-party service providers (including Twilio, ElevenLabs, AWS, and Stripe)
  • Internet service provider failures or network issues
  • Force majeure events (natural disasters, acts of government, pandemics, etc.)
  • Your equipment, software, or network connections
  • Scheduled maintenance

Enterprise customers may negotiate custom Service Level Agreements (SLAs) with specific uptime guarantees and service credits. Contact our sales team for details.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OO7 AI, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL OO7 AI'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO OO7 AI DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. OO7 AI DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Indemnification

You agree to indemnify, defend, and hold harmless OO7 AI, Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

  • Your access to or use of the Services
  • Your violation of these Terms
  • Your violation of any applicable law or regulation, including telemarketing and privacy laws
  • Your Content or any data you process through the Services
  • Any claims by third parties arising from calls made using your account
  • Your failure to obtain proper consent before placing calls

12. Termination

Either party may terminate these Terms at any time:

  • By you: You may terminate your account at any time through your account settings or by contacting support. Termination takes effect at the end of your current billing period.
  • By OO7 AI: We may suspend or terminate your account immediately if you violate these Terms, engage in illegal activity, or if we are required to do so by law. We may also terminate with 30 days' written notice for any reason.

Upon termination:

  • Your right to use the Services will cease immediately
  • You will have 30 days to export your data through the platform or by contacting support
  • After the 30-day export period, we will delete your data in accordance with our Privacy Policy
  • Provisions of these Terms that by their nature should survive termination will remain in effect (including limitation of liability, indemnification, and dispute resolution)

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.

14. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

  • The arbitration shall take place in San Francisco, California
  • The arbitration shall be conducted by a single arbitrator
  • The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction
  • Each party shall bear its own costs, and the parties shall share equally the fees of the arbitrator

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.

15. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will provide at least 30 days' notice before the changes take effect by:

  • Sending an email notification to the address associated with your account
  • Posting a prominent notice on our website
  • Updating the "Last Updated" date at the top of these Terms

Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Services and may terminate your account.
