2. TCPA Compliance

The Telephone Consumer Protection Act (TCPA) is the primary federal law governing telemarketing calls in the United States. OO7 AI provides comprehensive tools to help you comply with TCPA requirements:

Prior Express Consent Management

The TCPA requires prior express consent for most automated calls and prior express written consent for telemarketing calls. OO7 AI provides:

  • Consent tracking fields on every contact record
  • Timestamps and source documentation for all consent records
  • Automatic blocking of contacts without valid consent
  • Consent expiration tracking and renewal reminders

AI Disclosure at Start of Calls

Every call made through OO7 AI begins with a clear, mandatory disclosure that the recipient is speaking with an AI-powered voice agent. This disclosure cannot be disabled or bypassed and satisfies FCC requirements for AI voice identification.

Automatic Time-of-Day Restrictions

OO7 AI automatically enforces calling time restrictions based on the recipient's local time zone. By default, calls are blocked before 8:00 AM and after 9:00 PM in the recipient's local time. Administrators can configure more restrictive windows as needed, but cannot set hours outside the legally permitted range.

Caller ID Requirements

All calls made through OO7 AI transmit accurate caller ID information as required by federal law. We ensure that:

  • A valid callback number is transmitted with every call
  • The displayed phone number is answered during business hours
  • Caller ID spoofing is strictly prohibited on our platform
  • STIR/SHAKEN attestation is supported for call authentication

Abandoned Call Prevention

OO7 AI monitors for abandoned call patterns and maintains an abandonment rate below the FCC's 3% threshold. Our system automatically adjusts call pacing to prevent excessive abandoned calls and ensures a live AI agent is available to handle every connected call.

3. National DNC Registry

The Federal Trade Commission (FTC) maintains the National Do Not Call Registry, which contains phone numbers of consumers who have opted out of receiving telemarketing calls. OO7 AI integrates directly with the National DNC Registry to protect you from calling registered numbers.

DNC Scrubbing Process

Our automated DNC scrubbing process works as follows:

  • Import scrubbing: All contact lists are automatically scrubbed against the National DNC Registry when imported into the platform
  • Pre-campaign scrubbing: Contact lists are re-scrubbed before every campaign launch to catch recently added numbers
  • Registry updates: We download the latest DNC Registry data at least every 31 days, in compliance with FTC requirements
  • Automatic suppression: Numbers found on the DNC Registry are automatically suppressed and cannot be called through our platform for telemarketing purposes

Exceptions

Certain calls are exempt from DNC restrictions under the TCPA, including calls to consumers with whom you have an existing business relationship (within 18 months of the last transaction or 3 months of the last inquiry), calls made with prior express written consent, and calls for non-commercial purposes. OO7 AI allows you to flag contacts with valid exemptions, but the responsibility for verifying exemptions rests with you.

4. Internal DNC Lists

In addition to the National DNC Registry, the TCPA requires companies to maintain their own internal Do Not Call lists. OO7 AI provides robust tools for managing your company-specific DNC lists:

Instant Opt-Out Processing

When a call recipient requests to be placed on your Do Not Call list during a call, OO7 AI processes the opt-out immediately. The AI agent is trained to recognize opt-out requests in natural conversation and will:

  • Acknowledge the opt-out request
  • Confirm the phone number to be added to the DNC list
  • Immediately add the number to your internal DNC list
  • Log the opt-out request with timestamp and call details
  • End the call politely

Cross-Campaign Suppression

When a number is added to your internal DNC list, it is suppressed across all active and future campaigns in your account. This ensures that a consumer who opts out of one campaign is not contacted by any other campaign. Suppression is applied at the account level and takes effect within seconds of the opt-out request.

DNC List Management

OO7 AI provides a dedicated DNC management interface where you can:

  • View all numbers on your internal DNC list
  • Manually add or remove numbers (with audit trail)
  • Import DNC lists from external sources (CSV, API)

6. FCC AI Voice Ruling

February 2024 FCC Ruling: The Federal Communications Commission ruled that calls made with AI-generated voices are "artificial" voices under the TCPA. This means AI voice calls are subject to the same consent requirements and restrictions as robocalls made with prerecorded messages.

This ruling has significant implications for AI calling platforms. OO7 AI was designed with this regulatory reality in mind and provides the following compliance measures:

Mandatory AI Disclosure

Every call placed through OO7 AI begins with a clear disclosure that the call is being made by an AI voice agent. This disclosure is built into the platform at the infrastructure level and cannot be removed or circumvented by users. The disclosure identifies the calling party and states that the voice is AI-generated.

Consent Verification

Because AI-generated voice calls are classified as artificial/prerecorded voice calls under the TCPA, prior express written consent is required for telemarketing calls. OO7 AI provides tools to:

  • Track and store consent records with timestamps and source documentation
  • Verify that valid consent exists before a call is initiated
  • Automatically block calls to contacts without documented consent

Recording and Logging

Automatic Recording Disclosure

OO7 AI includes a recording disclosure as part of the call opening for all calls where recording is enabled. The disclosure is integrated with the AI agent's introduction and informs the recipient that the call may be recorded for quality assurance and compliance purposes.

Recording Retention

Call recordings are retained for 90 days by default. Account administrators can configure shorter retention periods based on their compliance requirements. Recordings are stored encrypted (AES-256) and are accessible only to authorized account users through the platform dashboard.
